Allgemeine Wallet Pay Bedingungen

Um den Wallet Pay Service mit einer Kredit- oder Prepaidkarte der Cornèr Bank AG, Zweigniederlassung BonusCard (Zürich) (Herausgeber, nachfolgend "BonusCard") nutzen zu können, muss der Karteninhaber den nachstehenden Geschäftsbedingungen zustimmen.

Handelt es sich bei der Kredit- oder Prepaidkarte um eine Firmenkarte, dann bestätigt der Karteninhaber, dass er nicht nur im eigenen Namen, sondern auch im Namen der Gesellschaft, welche Kontoinhaber ist, den nachstehenden Geschäftsbedingungen zustimmt.

1. Definitionen

App (Application): bezeichnet vom Wallet Pay Service Anbieter zur Erbringung von Wallet Pay Services bereitgestellte Anwendungssoftware für Mobilgeräte oder Wallet Pay Geräte.

Wallet Pay Service: Ein Dienst, mit dem Nutzer über unterstützte Wallet Pay Geräte mit Hilfe der virtuellen Darstellung einer Reihe von Kartentypen wie Kunden-, Eintritts- (z. B. Eventtickets) oder Zahlkarten (Kreditkarten, Prepaidkarten) kontaktlose Zahlungen, In-App Zahlungen oder Internet Zahlungen vornehmen können..

Wallet Pay Gerät: Jedes Produkt, das zur Speicherung und/oder Übermittlung der vom Herausgeber genehmigten und zur Verfügung gestellten Kartendaten eines Karteninhabers eingerichtet wurde.

Wallet Pay Funktion: Die vom Wallet Pay Service Anbieter bereitgestellte Funktion, die dem Karteninhaber die Durchführung von Kartentransaktionen mit Hilfe eines Wallet Pay Geräts über den Wallet Pay Service ermöglicht.

Karte: Die virtuelle Darstellung der von BonusCard herausgegebenen Kredit- oder Prepaidkarten, die von der BonusCard zur Nutzung der Wallet Pay Funktion zur Verfügung gestellt werden.

Karteninhaber: Die Person, an die eine Karte herausgegeben und für die die Wallet Pay Funktion eingerichtet wurde.

Karteninhabervertrag: Die zwischen der BonusCard und dem Karteninhaber resp. dem Kontoinhaber geschlossene Vereinbarung, in der die Nutzung der Karte geregelt ist, welche insbesondere aus einem unterzeichneten Antragsformular, den Allgemeinen Geschäftsbedingungen des Herausgebers für persönliche Zahlkarten sowie diesen Wallet Pay Geschäftsbedingungen besteht, einschliesslich gegebenenfalls aller Änderungen, Modifikationen oder Ergänzungen des Karteninhabervertrags.

Kartentransaktion(en): Jegliche Kartentransaktion(en), d. h. jeder Kauf von Waren und/oder Dienstleistungen durch Nutzung der Karte über eine kontaktlose Kartentransaktion an der Verkaufsstelle, durch eine In-App Zahlung oder Internet Zahlung mit einem Wallet Pay Gerät.

Kontoinhaber: Jeder Karte liegt ein Konto zugrunde, über welches alle Transaktionen von dazugehörenden Karten abgewickelt werden. Der Kontoinhaber ist der Hauptkarteninhaber oder im Fall von einer Firmenkarte eine Gesellschaft.

Personenbezogene Informationen: Sämtliche Informationen (z. B. Vorname, Nachname, Geburtsdatum, Wohnadresse, E-Mail-Adresse, Telefonnummer, IP-Adresse), die für sich genommen oder in Verbindung mit anderen Informationen dazu verwendet werden können, Personen zu identifizieren, zu kontaktieren oder zu lokalisieren oder eine Person aus dem Zusammenhang zu identifizieren.

2. Geschäftsbedingungen / Karteninhabervertrag

Die vorliegenden Geschäftsbedingungen ergänzen den Karteninhabervertrag und bilden einen integralen Bestandteil des Karteninhabervertrags. Beide Vereinbarungen zusammen regeln die Rechte und Pflichten des Herausgebers und des Karteninhabers resp. des Kontoinhabers in Bezug auf die Karte und deren Nutzung in Verbindung mit dem Wallet Pay Service. Die im Karteninhabervertrag definierten Bestimmungen und Bedingungen haben bei Verwendung in den vorliegenden Geschäftsbedingungen jeweils die gleiche Bedeutung, sofern in letzteren nichts anderes angegeben ist. Im Falle von Unstimmigkeiten zwischen diesen Geschäftsbedingungen und dem Karteninhabervertrag in Bezug auf den Wallet Pay Service sind die vorliegenden Geschäftsbedingungen massgebend. Der Herausgeber übernimmt keine Verantwortung für die Sicherheit, Richtigkeit, Rechtmässigkeit, Eignung des Inhalts oder der Funktion oder für irgendeinen anderen Aspekt betreffend den Inhalt oder die Funktion von Wallet Pay Service oder von Produkten oder Dienstleistungen Dritter. Es liegt in der Verantwortung des Karteninhabers resp. des Kontoinhabers, Verträge von Fremdanbietern durchzulesen und zu verstehen, bevor er eine Karte für den Wallet Pay Service beantragt, aktiviert oder nutzt.

3. Anmeldeverfahren

Die Einrichtung einer Karte für den Wallet Pay Service steht im alleinigen Ermessen des Herausgebers. Karteninhaber, die sich für den Wallet Pay Service anmelden, müssen die vom Herausgeber und/oder vom Anbieter des Wallet Pay Service im Rahmen des Anmeldeverfahrens zur Verfügung gestellte Anleitung befolgen. Der Karteninhaber stimmt im eigenen Namen und im Fall einer Firmenkarte auch im Namen der Gesellschaft zu, dass automatisch Updates oder Upgrades der Wallet Pay Eigenschaften bzw. der Wallet Pay Funktionalität seiner Karte vorgenommen werden können, ohne dass er darüber benachrichtigt wird. Der Herausgeber kann die Art und/oder Anzahl der bei Benutzung einer Karte erlaubten Transaktionen jederzeit erweitern, verringern oder aussetzen oder das Anmeldeverfahren ändern.

4. Nutzung der Karte / Verantwortlichkeiten des Karteninhabers resp. des Kontoinhabers

Der Karteninhaber darf niemandem gestatten, seine für die Wallet Pay Funktion eingerichtete Karte zu benutzen, und behält das Wallet Pay Gerät jederzeit unter seiner persönlichen Kontrolle. Der Karteninhaber ist insbesondere verpflichtet, die Wallet Pay Funktion zu deaktivieren, wenn er das Wallet Pay Gerät nicht für Kartentransaktionen nutzt. Der Karteninhaber muss sämtliche Informationen in seinem Wallet Pay Gerät löschen, wenn er es austauscht oder wechselt.

Der Karteninhaber darf ausserdem die Karte nicht in einem Wallet Pay Gerät nutzen, das mit illegal erworbenen, gehackten, gefälschten und/oder nicht autorisierten Anwendungen bestückt und/oder dessen Softwareverriegelung ausser Kraft gesetzt wurde (wie zum Beispiel Wallet Pay Geräte, deren Betriebssystem verändert wurde oder bei denen vom Hersteller gesperrte Anpassungen vorgenommen wurden). Der Karteninhaber lässt angemessene Umsicht und Sorgfalt bei der Geheimhaltung der Nutzer-ID, Passwörter, Zugangscodes und PINs sowie bei der Nutzung der Wallet Pay Funktion walten. Erhält der Karteninhaber Kenntnis davon oder hat er den Verdacht, dass eine PIN bekannt geworden und/oder ein Wallet Pay Gerät verloren gegangen oder auf sonstige Weise in den Besitz oder unter die Kontrolle von Unbefugten geraten ist oder dass nicht autorisierte Zahlungsvorgänge stattgefunden haben, so hat er dem Herausgeber den betreffenden Umstand unverzüglich persönlich oder telefonisch unter der Telefonnummer/den Telefonnummern mitzuteilen, die der Herausgeber jeweils vorschreibt. Bis zum tatsächlichen Eingang der Mitteilung beim Herausgeber bleibt der Karteninhaber resp. Kontoninhaber in vollem Umfang für jegliche Nutzung der Karte durch Unbefugte oder zu unbefugten Zwecken verantwortlich. Wird eine andere Person dazu eingesetzt, Transaktionen mit seinem aktivierten Wallet Pay Gerät durchzuführen, gelten diese als von ihm autorisiert. Der Karteninhaber resp. Kontoinhaber ist ferner verantwortlich für jegliche Nutzung durch Dritte und für alle von Dritten vorgenommenen Transaktionen, zu denen entweder der Karteninhaber des Hauptkontos und/oder weitere Inhaber von digitalen Karten Zugang gewährt haben, einschliesslich in Fällen, in denen diese Dritten eine Karte oder den Wallet Pay Service missbrauchen.

5. Haftungsbeschränkung / Stornierung der Karte

Der Herausgeber haftet nicht für Schäden oder Viren in Bezug auf Daten, Software, Computer-, Telekommunikations- oder sonstige Ausrüstungen des Karteninhabers resp. Kontoinhabers, die durch die Installation, das Starten und/oder die Nutzung der Karte und des Wallet Pay Service verursacht werden, ausser in Fällen, in denen dies auf grobe Fahrlässigkeit oder Vorsatz des Herausgebers zurückzuführen ist. Der Karteninhaber resp. Kontoninhaber ist dafür verantwortlich sicherzustellen, dass seine Telekommunikationsausrüstung kompatibel ist und die Nutzung der Karte unterstützt.

Der Karteninhaber resp. Kontoinhaber hat sämtliche Gebühren, Kosten oder Ausgaben zu tragen, die seitens des Mobilfunk- und/oder Telekommunikationsanbieters für die oder im Zusammenhang mit der Installation und/oder Nutzung der Karte für den Wallet Pay Service erhoben werden.

Der Karteninhaber kann die beim Wallet Pay Service angemeldete Karte jederzeit (mit oder ohne Stornierung oder Kündigung der Karte in Plastikkartenformat) durch schriftliche Mitteilung an den Herausgeber deaktivieren. Wenn er sein Wallet Pay Gerät nicht mehr nutzt, muss er alle seine Karten, persönlichen Daten und Finanzinformationen von seinem alten Wallet Pay Gerät löschen [Im Fall einer Firmenkarte kann der Kontoinhaber die beim Wallet Pay Service angemeldete Karte nur dadurch deaktivieren, dass er den Karteninhabervertrag gemäss Ziffer 5 der Allgemeinen Geschäftsbedingungen des Herausgebers für persönliche Zahlkarten kündigt]. Der Herausgeber kann eine beim Wallet Pay Service angemeldete Karte (mit oder ohne Stornierung oder Kündigung der Karte in Plastikkartenformat) jederzeit und in seinem Ermessen mit oder ohne vorherige Mitteilung deaktivieren.

Neben sämtlichen Rechten zur Kündigung, Stornierung, Aussetzung oder Deaktivierung seiner Karte behält der Herausgeber sich das Recht vor, Karten in seinem Ermessen (und falls möglich, mit angemessener Ankündigungsfrist) nicht mehr anzubieten oder zu unterstützen oder nicht (mehr) am Wallet Pay Service teilzunehmen. Der Herausgeber kann die Nutzung einer Karte sperren, einschränken, aussetzen oder beenden, wenn der Karteninhaber resp. Kontoinhaber gegen den Karteninhabervertrag oder diese Wallet Pay Geschäftsbedingungen verstösst oder wenn seitens Herausgeber der begründete Verdacht auf betrügerische Handlungen oder auf Missbrauch der Karte besteht.

6. Datensicherheit / Verfügbarkeit und weitere Bestimmungen

Der Herausgeber ist nicht verantwortlich und nicht haftbar für die Sicherheit der Daten des Karteninhabers resp. Kontoinhabers während deren Übertragung über das Internet und übernimmt keinerlei Verantwortung oder Haftung für direkte oder indirekte Schäden aufgrund des Verlusts oder des unbefugten Abfangens dieser Daten durch Dritte oder aufgrund der Nichteinhaltung der vorliegenden Geschäftsbedingungen. Der Karteninhaber autorisiert im eigenen Namen und im Fall einer Firmenkarte auch im Namen der Gesellschaft den Herausgeber, die kartenbezogenen Daten und die Daten für die Einrichtung der betreffenden Karte für den Wallet Pay Service an den Anbieter von Wallet Pay Service zu kommunizieren. Der Karteninhaber bestätigt und akzeptiert im eigenen Namen und im Fall einer Firmenkarte auch im Namen der Gesellschaft, dass die Erbringung des Wallet Pay Service vom Ausland aus erfolgen kann und dass dementsprechend Daten in Bezug auf den Karteninhaber resp. Kontoinhaber ins Ausland übermittelt und dort gespeichert werden müssen.

Sämtliche Aspekte, die in diesen Geschäftsbedingungen nicht behandelt werden, unterliegen in vollem Umfang den Allgemeinen Geschäftsbedingungen für die persönlichen Zahlkarten der BonusCard. Der Karteninhaber bestätigt und akzeptiert ferner im eigenen Namen und im Fall einer Firmenkarte auch im Namen der Gesellschaft, dass die Nutzung des Wallet Pay Service (einschliesslich insbesondere die Verwaltung von Daten und personenbezogenen Informationen des Karteninhabers resp. Kontoinhabers) den Allgemeinen Geschäftsbedingungen des Wallet Pay Anbieters unterliegt, deren Annahme durch den Karteninhaber im eigenen Namen und im Fall einer Firmenkarte auch im Namen der Gesellschaft eine aufschiebende Bedingung für den Zugang zum Wallet Pay Service und die Einrichtung der Karte für die Wallet Pay Funktion darstellt.

7. Änderungen der Geschäftsbedingungen

Der Herausgeber behält sich das Recht vor, Bestimmungen dieser Geschäftsbedingungen jederzeit zu ändern (oder zu streichen). Jegliche Änderungen gibt der Herausgeber über MyOnlineServices und auf den Produktwebseiten bekannt. Der Karteninhaber resp. Kontoinhaber soll sich diesbezüglich regelmässig über MyOnlineServices oder auf den Produktwebseiten informieren. Darüber hinaus kann der Herausgeber andere Benachrichtigungsmöglichkeiten wie z.B. E-Mail, Textbotschaften oder bei der nächsten Nutzung auf dem Display des Wallet Pay Geräts angezeigte Meldungen nutzen. Die vom Karteninhaber fortgesetzte Nutzung der Karte in Verbindung mit dem Wallet Pay Service gilt als Zustimmung des Karteninhabers resp. bei einer Firmenkarte auch als Zustimmung im Namen des Kontoinhabers zu den geänderten Geschäftsbedingungen.

8. Anwendbares Recht / Gerichtsstand

Dieser Vertrag untersteht dem schweizerischen materiellen Recht. Gerichtsstand, bei Inhabern mit Wohnsitz im Ausland auch Erfüllungsort, ist Zürich, zwingende gesetzliche Gerichtsstandvorschriften vorbehalten.

 


Wallet Pay – Conditions d’utilisation.

Pour pouvoir profiter du service Wallet Pay proposé en association avec l’utilisation d’une carte de crédit ou d’une carte prépayée émise par Cornèr Banque SA, Succursale BonusCard (Zurich) (l’émetteur, "BonusCard"), le titulaire de la carte doit accepter les présentes conditions d’utilisation.

Si la carte de crédit ou la carte prépayée est une carte d’entreprise, le titulaire de la carte confirme qu’il accepte les présentes conditions d’utilisation en son nom et en celui de la société qui détient le compte.

1. Définitions

Application fait référence au logiciel d’application pour appareils mobiles ou pour appareils Wallet Pay mis à disposition par le fournisseur du service Wallet Pay pour la fourniture des services Wallet Pay.

Service Wallet Pay fait référence à un service qui permet à ses utilisateurs d’effectuer des paiements sans contact ou via une application ou via Internet à l’aide d’appareils prenant en charge cette fonctionnalité et utilisant la représentation virtuelle de divers types de cartes comme les cartes de magasin, les passes (par exemple pour les billets de spectacle) et les cartes de paiement (cartes de crédit, cartes prépayées).

Appareil Wallet Pay fait référence à tout produit capable d’enregistrer et/ou de transmettre les informations de la carte d’un titulaire, approuvées et fournies par l’émetteur.

Fonction Wallet Pay fait référence à la fonction mise à disposition par le fournisseur du service Wallet Pay, qui permet au titulaire d’effectuer des transactions par carte à l’aide d’un appareil Wallet Pay via le service Wallet Pay.

Carte fait référence à la représentation virtuelle de la carte de crédit ou de la carte prépayée émise par BonusCard et mise à disposition par BonusCard pour l’utilisation de la fonction Wallet Pay.

Titulaire fait référence à la personne physique ou à la personne morale pour laquelle une carte a été émise et pour laquelle la fonction Wallet Pay a été activée.

Convention de titulaire de carte fait référence à la convention liant BonusCard au titulaire et au titulaire du compte et régissant l’utilisation de la carte. Elle est notamment constituée d’un formulaire de demande signé, des conditions générales d’utilisation des cartes de paiement personnelles de l’émetteur ainsi que des présentes conditions d’utilisation du service Wallet Pay, et comprend les avenants, les modifications et les suppléments éventuels apportés à la Convention de titulaire de carte.

Transaction(s) par carte fait référence à toute transaction par carte, c’est-à-dire à tout achat de bien et/ou de service effectué au moyen de la carte dans le cadre d’une transaction sans contact au point de vente ou d’un paiement via une application ou via Internet à l’aide d’un appareil Wallet Pay.

Titulaire du compte fait référence au titulaire principal ou, dans le cas d’une carte d’entreprise, à la société. Chaque carte se fonde sur un compte via lequel sont exécutées toutes les transactions des cartes qui lui sont liées.

Données personnelles fait référence à toute information (par exemple prénom, nom, date de naissance, adresse, adresse e-mail, numéro de téléphone, adresse IP) susceptible d’être utilisée, isolément ou en lien avec d’autres informations, pour identifier, contacter ou localiser une personne ou encore pour identifier un individu dans un contexte.

2. Conditions d’utilisation / Convention de titulaire de carte

Les présentes conditions d’utilisation complètent la Convention de titulaire de carte et en font partie intégrante. Ensemble, elles déterminent les droits et obligations de l’émetteur et du titulaire ainsi que du titulaire du compte concernant la carte et son utilisation dans le cadre du service Wallet Pay. Sauf stipulation contraire explicite dans les présentes conditions d’utilisation, les dispositions et les conditions définies dans la Convention de titulaire de carte ont la même signification respective lorsqu’elles sont utilisées dans les présentes conditions d’utilisation. En cas d’incohérence entre ces conditions d’utilisation et la Convention de titulaire de carte en ce qui concerne le service Wallet Pay, les présentes conditions d’utilisation prévalent. L’émetteur n’est pas responsable de la sécurité, de la précision, du caractère légal, de l’opportunité, ni de tout autre aspect du contenu ou de la fonction du service Wallet Pay ou de tout autre produit ou service tiers. Il est de la responsabilité du titulaire et du titulaire du compte de lire et de comprendre tout accord impliquant un tiers avant de demander, d’activer ou d’utiliser une carte en lien avec le service Wallet Pay.

3. Processus d’inscription

L’activation d’une carte pour le service Wallet Pay est à la discrétion absolue de l’émetteur. Les titulaires souhaitant bénéficier du service Wallet Pay suivront les instructions communiquées par l’émetteur et le fournisseur du service Wallet Pay au moment du processus d’inscription. Le titulaire accepte, en son nom et, dans le cas des cartes d’entreprise, en celui de la société, que les fonctionnalités et les caractéristiques Wallet Pay de sa carte soient automatiquement mises à jour ou améliorées sans préavis. L’émetteur peut à tout moment décider d’augmenter, de réduire ou de suspendre le type et/ou le montant des transactions autorisées par carte ou de modifier le processus d’inscription.

4. Utilisation de la carte / responsabilités du titulaire et du titulaire du compte

Le titulaire ne permettra à personne d’utiliser sa carte activée pour la fonction Wallet Pay et conservera à tout moment l’appareil Wallet Pay sous son contrôle. Le titulaire désactivera notamment la fonction Wallet Pay lorsqu’il ne se servira pas de l’appareil Wallet Pay pour les transactions par carte et effacera toutes les informations de l’appareil Wallet Pay lorsqu’il l’échangera ou le remplacera.

Le titulaire n’utilisera pas la carte avec un appareil Wallet Pay qui comporte des applications acquises illégalement, piratées, falsifiées et/ou non autorisées et/ou pour lequel le verrouillage logiciel a été contourné (par exemple un appareil Wallet Pay «débridé» ou «rooté»). Le titulaire agira de bonne foi et fera preuve d’une prudence et d’une diligence raisonnées concernant la confidentialité de ses identifiants, mots de passe, codes d’accès et codes NIP et l’utilisation de la fonction Wallet Pay. Si le titulaire est informé de la divulgation d’un code NIP ou qu’il soupçonne un tel incident et/ou s’il a perdu l’appareil Wallet Pay ou que ce dernier est entré en possession ou se trouve sous le contrôle d’un tiers ou si des transactions de paiement ont été effectuées sans son accord, le titulaire s’engage à en informer immédiatement l’émetteur en personne ou au(x) numéro(s) de téléphone indiqué(s) par l’émetteur. Le titulaire et le titulaire du compte resteront responsables de toute utilisation de la carte par des personnes non autorisées ou à des fins non autorisées jusqu’à information de l’émetteur. En cas de transaction effectuée au moyen de l’appareil Wallet Pay du titulaire par une tierce personne, il sera considéré que ladite personne bénéficie de l’accord de ce dernier. Le titulaire et le titulaire du compte seront également considérés responsables de toute utilisation par un tiers et de toute transaction effectuées par un tiers et permises par le titulaire du compte principal et/ou d’autres titulaires de cartes numériques, y compris en cas d’utilisation frauduleuse de la carte ou du service Wallet Pay.

5. Limitation de responsabilité / annulation de la carte

Sauf en cas de négligence flagrante ou de faute volontaire de la part de l’émetteur, celui-ci ne pourra être tenu responsable d’éventuels dégâts ou virus touchant les données, les logiciels, les équipements informatiques ou de télécommunication ou d’autres équipements du titulaire ou du titulaire du compte causés par l’installation, l’exécution et/ou l’utilisation de la carte et du service Wallet Pay. Le titulaire et le titulaire du compte doivent s’assurer qu’ils disposent d’équipements de télécommunication compatibles permettant l’utilisation de la carte.

Les frais facturés par les prestataires de services de téléphonie mobile et/ou les fournisseurs de télécommunication pour l’installation et/ou l’utilisation de la carte en relation avec le service Wallet Pay sont à la charge du titulaire et du titulaire du compte.

Le titulaire peut désactiver sa carte activée pour le service Wallet Pay (en annulant/résiliant ou non la carte sous sa forme plastique) à tout moment en informant par écrit l’émetteur. S’il n’utilise plus l’appareil Wallet Pay, il doit effacer toutes ses cartes et toutes les informations personnelles et financières se trouvant sur son ancien appareil Wallet Pay. [Dans le cas d’une carte d’entreprise, le titulaire du compte ne peut désactiver la carte activée pour le service Wallet Pay qu’en résiliant la Convention de titulaire de carte conformément au point 5 des conditions générales d’utilisation des cartes de paiement personnelles de l’émetteur.] L’émetteur peut désactiver une carte activée pour le service Wallet Pay (en annulant/résiliant ou non la carte sous sa forme plastique) à tout moment et à sa discrétion, avec ou sans préavis.

En plus des droits de résiliation, d’annulation, de suspension ou de désactivation de la carte, l’émetteur se réserve le droit, à sa discrétion (en donnant un préavis raisonnable lorsque cela sera possible), de cesser d’offrir ou de prendre en charge toute carte ou de participer au service Wallet Pay. L’émetteur peut bloquer, restreindre, suspendre ou résilier l’utilisation de toute carte en cas d’infraction du titulaire ou du titulaire du compte à la Convention de titulaire de carte ou aux présentes conditions d’utilisation du service Wallet Pay ou en cas de soupçons d’activité frauduleuse ou d’utilisation détournée de la carte.

6. Sécurité des données / clauses supplémentaires

L’émetteur ne peut être tenu responsable de la sécurité des données du titulaire et du titulaire du compte lors de leur transmission via Internet ni d’éventuels dommages directs ou indirects résultant de la perte ou de l’interception sans autorisation de ces données par un tiers ou découlant du non-respect des présentes conditions d’utilisation. Le titulaire autorise, en son nom et, dans le cas des cartes d’entreprise, en celui de la société, l’émetteur à communiquer au fournisseur du service Wallet Pay les données liées à la carte et à l’activation de cette carte dans le cadre de l’utilisation du service Wallet Pay. Le titulaire reconnaît et accepte, en son nom et, dans le cas des cartes d’entreprise, en celui de la société, que le service Wallet Pay peut être opéré depuis l’étranger et que, par conséquent, ses données et celles du titulaire du compte peuvent être transférées et stockées à l’étranger.

Tout problème non prévu par les présentes conditions d’utilisation est régi par les conditions générales d’utilisation des cartes de paiement personnelles de BonusCard. Le titulaire reconnaît et accepte par ailleurs, en son nom et, dans le cas des cartes d’entreprise, en celui de la société, que l’utilisation du service Wallet Pay (en particulier en ce qui concerne la gestion des données et des données personnelles du titulaire et du titulaire du compte) est régie par les conditions générales d’utilisation du fournisseur du service Wallet Pay, dont l’acceptation par le titulaire en son nom et, dans le cas des cartes d’entreprise, en celui de la société est un prérequis pour accéder au service Wallet Pay et activer la carte pour la fonction Wallet Pay.

7. Modifications des conditions d’utilisation

L’émetteur se réserve le droit de modifier (ou de supprimer) à tout moment certaines clauses des présentes conditions d’utilisation. L’émetteur communiquera toute modification via MyOnlineServices et sur ses pages produit Internet. Le titulaire et le titulaire du compte sont tenus de consulter régulièrement MyOnlineServices ou les pages produit Internet. L’émetteur pourra également utiliser d’autres moyens d’information tels qu’un e-mail, un SMS ou une alerte s’affichant sur l’appareil Wallet Pay lors de la prochaine utilisation du service Wallet Pay. La poursuite de l’utilisation de la carte en lien avec le service Wallet Pay sera considérée comme une acceptation par le titulaire et, dans le cas des cartes d’entreprise, également au nom du titulaire du compte, des modifications apportées aux conditions d’utilisation.

8. Droit applicable/for juridique

La présente convention est régie par le droit matériel suisse. Le for compétent ainsi que le lieu d’exécution pour les titulaires domiciliés hors de Suisse se trouvent à Zurich, sous réserve des réglementations légales obligatoires propres aux fors.


Wallet Pay – condizioni generali.

Per usufruire del servizio Wallet Pay utilizzando carte di credito o prepagate rilasciate da Cornèr Banca SA, Succursale BonusCard (Zurigo) (emittente, "BonusCard"), il titolare della carta dovrà accettare le seguenti condizioni generali.

Se la carta di credito o prepagata è una carta aziendale, il titolare della carta dichiara di accettare le condizioni generali riportate qui di seguito non solo a nome proprio bensì anche a nome dell’azienda intestataria del conto.

1. Definizioni

L’app (o applicazione) è il software messo a disposizione dal fornitore del servizio Wallet Pay che permette di usufruire dei servizi Wallet Pay via dispositivo mobile o Wallet Pay.

Il servizio Wallet Pay è un servizio che consente agli utenti di eseguire pagamenti senza contatto, in‑app o su Internet mediante dispositivi che supportano questo tipo di funzione utilizzando la rappresentazione virtuale di diversi tipi di carte come carte clienti, carte d’ingresso (ad esempio biglietti per eventi) e carte di pagamento (carte di credito, carte prepagate).

Con dispositivo Wallet Pay si fa riferimento a qualunque prodotto che consente di conservare e/o trasmettere i dati della carta del titolare che sono stati approvati e forniti dall’emittente.

Per funzione Wallet Pay si intende la funzione messa a disposizione dal servizio Wallet Pay che consente al titolare della carta di eseguire transazioni con la carta utilizzando un dispositivo Wallet Pay con il servizio omonimo.

Per carta si intende la rappresentazione virtuale della carta di credito o prepagata rilasciata da BonusCard e messa a disposizione dalla stessa per un utilizzo nell’ambito della funzione Wallet Pay.

Per titolare della carta si intende la persona fisica o l’entità giuridica a cui è stata rilasciata la carta autorizzata alla funzione Wallet Pay.

Per contratto con il titolare della carta si intende un contratto stipulato tra BonusCard e il titolare della carta ovvero l’azienda intestataria del conto che disciplina l’utilizzo di una carta e consiste in particolare nel modulo di richiesta firmato, nelle condizioni generali relative alle carte di pagamento personali previste dall’emittente nonché nelle presenti condizioni generali relative a Wallet Pay, comprese eventuali variazioni, modifiche o integrazioni che potranno essere apportate al presente contratto stipulato con il titolare della carta.

Per transazione/-i con la carta si intende qualunque transazione effettuata con la carta, ossia qualunque acquisto di merci e/o servizi mediante l’utilizzo della carta attraverso una transazione con carta senza contatto nel punto vendita o per effettuare un pagamento in-app o su Internet utilizzando un dispositivo Wallet Pay.

Premesso che ad ogni carta è associato un conto, tramite cui viene effettuato l’insieme delle relative transazioni, l’intestatario del conto è il principale titolare della carta o, nel caso di una carta aziendale, l’azienda a cui è intestato.

Per dati personali si intende qualunque informazione (ad esempio nome, cognome, data di nascita, indirizzo di casa, indirizzo e-mail, numero di telefono, indirizzo IP) che possa essere utilizzata, da sola o insieme ad altre informazioni, per identificare, contattare o individuare una singola persona o per identificare un individuo sulla base del contesto.

2. Condizioni generali / contratto con il titolare della carta

Le presenti condizioni generali completano il contratto con il titolare della carta e ne sono parte integrante. Insieme disciplinano i diritti e gli obblighi dell’emittente e del titolare della carta ovvero dell’azienda intestataria del conto per quanto riguarda la carta e il suo utilizzo in relazione al servizio Wallet Pay. Le disposizioni e le condizioni definite nel contratto con il titolare della carta presentano lo stesso significato nell’ambito delle presenti condizioni generali, salvo diversamente definite. In caso di incongruenze tra le presenti condizioni generali e il contratto con il titolare della carta per quanto riguarda i servizi Wallet Pay, prevarranno le presenti condizioni generali. L’emittente non è responsabile della sicurezza, dell’esattezza, della legittimità, dell’adeguatezza o di qualsiasi altro aspetto che riguardi il contenuto o la funzione del servizio Wallet Pay o di eventuali prodotti o servizi di terzi. Spetta al titolare della carta ovvero all’azienda intestataria del conto leggere e comprendere gli accordi presi con terzi prima di richiedere, attivare o utilizzare una carta per il servizio Wallet Pay.

3. Procedura di registrazione

L’attivazione di una carta per il servizio Wallet Pay è ad assoluta discrezione dell’emittente. I titolari delle carte che si registrano al servizio Wallet Pay devono seguire le indicazioni fornite dall’emittente e/o dal fornitore del servizio Wallet Pay durante la procedura di registrazione. Il titolare della carta acconsente a nome proprio e, nel caso di una carta aziendale, anche a nome dell’azienda a che le funzioni Wallet Pay e la funzionalità della propria carta possano essere automaticamente aggiornate o migliorate senza alcun preavviso. L’emittente può decidere in qualsiasi momento se estendere, ridurre o sospendere la tipologia e/o gli importi delle transazioni consentite utilizzando una carta o modificare la procedura di registrazione.

4. Uso della carta / responsabilità del titolare della carta

Il titolare della carta non deve consentire a nessuno di utilizzare la propria carta abilitata alla funzione Wallet Pay e si impegna a tenere sempre sotto controllo il dispositivo Wallet Pay. Il titolare della carta è tenuto, in particolare, a disattivare la funzione Wallet Pay quando non utilizza il dispositivo Wallet Pay per effettuare le transazioni con la carta. Si raccomanda al titolare della carta di eliminare tutte le informazioni contenute nel proprio dispositivo Wallet Pay qualora decida di cambiare o sostituire il proprio dispositivo Wallet Pay.

Al titolare della carta non è inoltre permesso di utilizzare la carta mediante un dispositivo Wallet Pay dove siano presenti applicazioni pirata, illegali, falsificate e/o non autorizzate o in cui il blocco software sia stato disabilitato (come ad esempio, ma non solo, un dispositivo Wallet Pay sottoposto a jailbreak o root). Il titolare della carta deve agire in buona fede ed esercitare ragionevole cura e diligenza nel mantenere segreti l’ID utente, le password, i codici di accesso e i NIP nonché nell’utilizzare la funzione Wallet Pay. In caso di comunicazione o sospetto di un’eventuale divulgazione di qualsiasi NIP e/o di smarrimento del dispositivo Wallet Pay, qualora lo stesso entri in possesso o finisca sotto il controllo di persone non autorizzate o in caso di esecuzione di qualsivoglia transazione di pagamento non autorizzata, il titolare della carta dovrà immediatamente informare l’emittente di quanto accaduto, di persona o per telefono, al recapito o ai recapiti telefonici indicati dal medesimo e, fino all’effettivo ricevimento della notifica da parte dell’emittente, il titolare ovvero l’azienda intestataria del conto resterà pienamente responsabile di qualsiasi utilizzo della carta da parte di persone non autorizzate o per scopi non consentiti. Nel caso in cui un’altra persona esegua transazioni con il dispositivo Wallet Pay del titolare, si supporrà che quest’ultimo abbia fornito autorizzazione per l’esecuzione delle stesse. Il titolare della carta ovvero l’azienda intestataria del conto sarà altresì responsabile di tutti gli utilizzi e le transazioni effettuati da terzi a cui il titolare della carta del conto principale e/o il titolare della carta digitale supplementare abbia fornito l’accesso, ivi compresi i casi di utilizzo abusivo di qualunque carta o del servizio Wallet Pay da parte di terzi.

5. Limitazione di responsabilità / cancellazione della carta

Fatta eccezione per i danni causati da negligenza grave o da cattiva condotta intenzionale dell’emittente, lo stesso non sarà ritenuto responsabile di eventuali danni o virus ai dati, al software, al computer, alle apparecchiature di telecomunicazione o ad altre apparecchiature di proprietà del titolare della carta ovvero dell’azienda intestataria del conto causati dall’installazione, dall’attivazione e/o dall’utilizzo della carta e del servizio Wallet Pay. Il titolare della carta è tenuto a garantire di essere in possesso di apparecchiature di telecomunicazione in grado di supportare l’utilizzo della carta.

Il titolare della carta ovvero l’azienda intestataria del conto sosterrà tutte le commissioni, gli oneri o le spese che potranno essere addebitati dal gestore di telefonia mobile e/o di telecomunicazioni per o in relazione all’installazione e/o all’utilizzo della carta per il servizio Wallet Pay.

Il titolare della carta potrà disattivare la carta sul servizio Wallet Pay in qualsiasi momento (con o senza annullamento o rescissione della carta in formato plastificato), previa comunicazione scritta all’emittente. Una volta che il titolare smetterà di utilizzare il dispositivo Wallet Pay, sarà tenuto a eliminare tutte le carte registrate sul vecchio dispositivo Wallet Pay nonché le informazioni personali e finanziarie. [Nel caso di una carta aziendale, l’azienda intestataria del conto può disattivare la carta registrata sul servizio Wallet Pay esclusivamente rescindendo dal contratto con il titolare della carta ai sensi del punto 5 di cui alle condizioni generali relative alle carte di pagamento personali dell’emittente.] L’emittente potrà disattivare una carta registrata sul servizio Wallet Pay (con o senza annullamento o rescissione della carta in formato plastificato), con o senza preavviso, in qualsiasi momento e a propria discrezione.

Oltre al diritto di rescissione, annullamento, sospensione o disattivazione della carta del titolare, l’emittente si riserva il diritto, dandone comunicazione entro un tempo ove possibile ragionevole, di interrompere per qualsivoglia motivo la fornitura dei propri servizi o l’assistenza di qualsiasi carta o di non partecipare (più) al servizio Wallet Pay. L’emittente potrà bloccare, limitare, sospendere o disdire l’utilizzo di qualsiasi carta in caso di violazione, da parte del titolare della carta ovvero dell’azienda intestataria del conto, del contratto con il titolare della carta o delle presenti condizioni generali Wallet Pay oppure qualora l’emittente avesse ragionevole sospetto di un’attività fraudolenta o di un abuso della carta.

6. Sicurezza dei dati / ulteriori disposizioni

L’emittente non risponde e non potrà essere ritenuto responsabile della sicurezza dei dati del titolare della carta ovvero dell’azienda intestataria del conto durante la trasmissione via Internet e si solleva da qualsivoglia responsabilità per eventuali danni diretti o indiretti derivanti dalla perdita o dall’intercettazione non autorizzata di tali dati da parte di terzi o conseguenti al mancato rispetto delle presenti condizioni generali. Il titolare della carta autorizza l’emittente, a nome proprio e, nel caso di una carta aziendale, a nome anche dell’azienda, a comunicare i dati della carta e la relativa abilitazione per l’impiego con il servizio Wallet Pay al fornitore del servizio Wallet Pay. Il titolare della carta prende atto e accetta a nome proprio e, nel caso di una carta aziendale, a nome anche dell’azienda che i servizi Wallet Pay possano essere effettuati all’estero e che, di conseguenza, i dati relativi al titolare della carta ovvero all’azienda intestataria del conto possano essere trasferiti e immagazzinati anche in un altro paese.

Per quanto riguarda qualunque altra questione non trattata nel presente documento, si applicano integralmente le condizioni generali previste da BonusCard per le carte di pagamento personali. Il titolare della carta prende inoltre atto e accetta a nome proprio e, nel caso di una carta aziendale, a nome anche dell’azienda che l’utilizzo del servizio Wallet Pay (inclusa in particolare la gestione dei dati della carta e dei dati personali del rispettivo titolare della carta ovvero dell’azienda intestataria del conto) sia regolato dalle condizioni generali previste dal fornitore del servizio Wallet Pay, la cui accettazione da parte del titolare della carta è condizione essenziale per poter accedere al servizio Wallet Pay e abilitare la carta alla funzione Wallet Pay.

7. Modifiche alle condizioni generali

L’emittente si riserva il diritto di modificare (o eliminare) in qualsiasi momento qualsivoglia disposizione contenuta nelle presenti condizioni generali. L’emittente provvederà a informare il titolare della carta riguardo a eventuali modifiche all’interno di MyOnlineServices e sulle pagine web relative ai propri prodotti. Il titolare della carta ovvero l’azienda intestataria del conto è pertanto invitato a consultare regolarmente MyOnlineServices o le pagine web relative ai prodotti dell’emittente. Quest’ultimo potrà utilizzare anche altri mezzi di comunicazione come e-mail, messaggi di testo o un avviso che verrà visualizzato sul dispositivo Wallet Pay al momento dell’utilizzo successivo del servizio Wallet Pay. La continuazione dell’utilizzo della carta tramite il servizio Wallet Pay, da parte del titolare della carta o dell’azienda intestataria del conto, verrà considerato come un assenso del medesimo a nome proprio e, nel caso di una carta aziendale, a nome anche dell’azienda alle condizioni generali modificate.

8. Legge applicabile, giurisdizione

Il presente accordo è disciplinato dal diritto sostanziale svizzero. Foro competente nonché luogo di adempimento ed esecuzione riservato ai titolari di carta domiciliati al di fuori della Svizzera è Zurigo, salvo applicazione di normative obbligatorie in materia di competenza giurisdizionale.


Wallet Pay – Terms and Conditions.

To use the Wallet Pay Service with a Cornèr Bank Limited, Branch BonusCard (Zurich) (Issuer, "BonusCard") Credit or Prepaid Card, the Cardholder must agree to the following Terms and Conditions.

If the Credit or Prepaid Card is a corporate card, the Cardholder confirms that they agree to the Terms and Conditions set out below, not only on their own behalf, but on behalf of the company that is the Account Holder.

1. Definitions

“App” (application) means any application software made available by Wallet Pay Service providers that allows users to access Wallet Pay Services via mobile device or Wallet Pay Device.

“Wallet Pay Service” is a service that enables users to make contactless and in-app and Internet payments with supported Wallet Pay Devices, using virtual representation of several types of cards, such as store cards, passes (e.g. event tickets), and payment cards (credit cards, prepaid cards).

“Wallet Pay Device” means any product that has been enabled to store and/or transmit the Card credentials of a Cardholder approved and provided by the Issuer.

“Wallet Pay Function” means the function made available by the Wallet Pay Service provider, which allows the Cardholder to perform Card Transactions using a Wallet Pay Device with the Wallet Pay Service.

“Card” means the virtual representation of the BonusCard issued Credit or Prepaid Card made available by BonusCard for use in connection with the Wallet Pay Function.

“Cardholder” means the natural person or legal entity to whom a Card has been issued and enabled for the Wallet Pay Function.

“Cardholder Agreement” means the agreement between BonusCard and the Cardholder/Account Holder governing the use of a Card, consisting in particular of a signed application form, the Issuer’s General Terms and Conditions for the Use of Personal Payment Cards, and these Wallet Pay Terms and Conditions, including any amendments, modifications, or supplements that may be made to such Cardholder Agreement.

“Card Transaction(s)” means any Card Transaction(s), i.e. any purchase of goods and/or services by use of the Card, through a contactless Card Transaction at the point of sale, or through an in-app payment or Internet payment with a Wallet Pay Device.

“Account Holder” means the person (or company in the case of corporate cards) designated as the main Cardholder. Each Card is linked to an underlying account through which all Card Transactions are routed.

“Personally identifiable information” is any information (e.g. first name, last name, date of birth, home address, e-mail address, phone number, IP address) that can be used, by itself or in connection with other information, to identify, contact, or locate a single person, or to identify an individual from context.

2. Terms and Conditions / Cardholder Agreement

These Terms and Conditions supplement and form an integral part of the Cardholder Agreement and together they govern the rights and obligations of the Issuer, Cardholder and Account Holder in respect of the Card and its use in connection with the Wallet Pay Service. Terms and Conditions defined in the Cardholder Agreement have the same respective meanings when used in these Terms and Conditions, unless otherwise defined in these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions and the Cardholder Agreement regarding the Wallet Pay Service, these Terms and Conditions will prevail. The Issuer is not responsible for the security, accuracy, legality, appropriateness, or any other aspect of the content or function of the Wallet Pay Service or any third-party products or services. It is responsibility of the Cardholder and the Account Holder to read and understand the third-party agreements before creating, activating, or using a Card for the Wallet Pay Service.

3. Enrollment Process

The enablement of a Card for the Wallet Pay Service is at the Issuer’s absolute discretion. Cardholders enrolling for the Wallet Pay Service shall follow the guidance provided by the Issuer and/or the Wallet Pay Service provider during the enrollment process. The Cardholder agrees on their own behalf and, if the Card is a corporate card, also on behalf of the company that the Wallet Pay features and functionality of their Card may be automatically updated or upgraded without notice to the Cardholder. At any time, the Issuer may decide to expand, reduce, or suspend the type and/or amounts of transactions allowed using a Card, or change the enrollment process.

4. Use of Card / Responsibilities of Cardholder and Account Holder

The Cardholder shall not permit anyone to use their Card enabled for the Wallet Pay Function and will at all times keep the Wallet Pay Device under the Cardholder’s personal control. The Cardholder shall, in particular, deactivate the Wallet Pay Function when not using the Wallet Pay Device for Card Transactions and delete all the information in the Wallet Pay Device when exchanging or swapping the Wallet Pay Device.

The Cardholder further shall not set up and/or use the Card in a Wallet Pay Device with any pirated, hacked, fake, and/or unauthorized applications, or in which the software lockdown has been overridden (such as, but not limited to, a jailbroken or rooted Wallet Pay Device). The Cardholder shall act in good faith and exercise reasonable care and diligence in keeping the user ID, passwords, passcodes, and PIN secret and in using the Wallet Pay Function. Upon notice or suspicion of any PIN being disclosed to, and/or the Wallet Pay Device being lost or otherwise coming into the possession or control of any unauthorized person or any unauthorized payment transactions being made, the Cardholder shall immediately notify the Issuer of such incident in person or by telephone at such telephone number(s) that the Issuer may from time to time prescribe and, until the Issuer’s actual receipt of such notification, the Cardholder and the Account Holder will remain fully responsible for any and all use of the Card by unauthorized persons or for unauthorized purposes. If another person makes transactions with the Cardholder’s enabled Wallet Pay Device, these will be assumed to be authorized by the Cardholder. The Cardholder and the Account Holder will also be responsible for all uses and transactions made by third parties that either the main account and/or additional Digital Cardholder gives access to, including if these third parties misuse any Card or the Wallet Pay Service.

5. Limitation of Liability / Cancellation of the Card

Except where caused by the Issuer’s gross negligence or willful misconduct, the Issuer is not liable for any damage to or viruses affecting a Cardholder’s and Account Holder’s data, software, computer, telecommunications equipment, or other equipment of the Cardholder and Account Holder caused by the installation, launch, and/or use of the Card and Wallet Pay Service. The Cardholder and Account Holder are responsible for ensuring they have compatible telecommunications equipment that supports the use of the Card.

The Cardholder and Account Holder shall bear all fees, charges, or expenses that may be charged by mobile phone service providers and/or telecommunications providers for, or in relation to, the installation and/or use of the Card for the Wallet Pay Service.

A Cardholder may deactivate the Card on the Wallet Pay Service (with or without cancelling or terminating the Card in plastic card form) at any time by written notice to the Issuer. If the Cardholder stops using their Wallet Pay Device, the Cardholder must delete all their Cards and personal and financial information from their old Wallet Pay Device. [If a corporate card has been issued, the Cardholder may only deactivate the Card on the Wallet Pay Service by terminating the Cardholder Agreement in accordance with clause 5 of the Issuer’s General Terms and Conditions for the Use of Personal Payment Cards]. The Issuer may deactivate a Card (with or without cancelling or terminating the Card in plastic card form) on the Wallet Pay Service at any time and at its discretion, with or without giving prior notice.

In addition to any rights of termination, cancellation, suspension, or deactivation of the Cardholder’s Card, the Issuer reserves the right for any reason (on giving reasonable notice where possible) to discontinue offering or supporting any Card or to not participate in the Wallet Pay Service. The Issuer may block, restrict, suspend, or terminate the Cardholder’s use of any Card if the Cardholder or the Account Holder breach the Cardholder Agreement or these Wallet Pay Terms and Conditions, or if the Issuer has reasonable suspicion of any fraudulent activity or misuse of the Card.

6. Data Security / Further provisions

The Issuer has no responsibility, and will not be liable, for the security of the data of the Cardholder or Account Holder during its transmission over the Internet and shall assume no responsibility or liability for any direct or indirect damage resulting from the loss or unauthorized interception of such data by a third party or arising from failure to comply with the present Terms and Conditions. The Cardholder authorizes the Issuer on their own behalf and, if the Card is a corporate card, also on behalf of the company to communicate the data related to the Card and to the enablement of such Card for the Wallet Pay Service to the Wallet Pay Services provider. The Cardholder acknowledges and accepts on their own behalf and, if the Card is a corporate card, also on behalf of the company that the Wallet Pay Services may be operated abroad and that, accordingly, any data pertaining to the Cardholder or Account Holder may have to be transferred and stored abroad.

With respect to any other issue not addressed herein, the General Terms and Conditions of BonusCard for the Use of Personal Payment Cards fully apply. The Cardholder acknowledges and accepts on their own behalf and, if the Card is a corporate card, also on behalf of the company (or Account Holder) that the use of the Wallet Pay Service (including in particular the management of data and personally identifiable information pertaining to the Cardholder or Account Holder) is governed by the Wallet Pay Service provider’s General Terms and Conditions, the acceptance of which by the Cardholder on their own behalf and, if the Card is a corporate card, also on behalf of the company, is a condition precedent to accessing the Wallet Pay Service and enabling the Card for the Wallet Pay Function.

7. Changes to Terms and Conditions

The Issuer reserves the right to amend (or remove) any terms of these Terms and Conditions at any time. The Issuer will publish details of any amendments in MyOnlineServices and on the product web pages. The Cardholder and the Account Holder should consult MyOnlineServices or the product web pages regularly. The Issuer may also use other means of notification such as e-mail, text message, or an alert displayed on the Cardholder’s Wallet Pay Device when the Cardholder next uses the Wallet Pay Service. In continuing to use the Card in connection with the Wallet Pay Service, the Cardholder will be deemed to have accepted the amended Terms and Conditions, both on their own behalf and, if the Card is a corporate Card, on behalf of the Account Holder.

8. Applicable Law / Jurisdiction

The present agreement is governed by Swiss substantive law. The competent jurisdiction, as well as the place of performance and execution for Cardholders domiciled outside of Switzerland, is Zurich, subject to compulsory legal jurisdiction regulations.
